1. Acceptance of Terms

By downloading, installing, or using MurmurAI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Samarth Agarwal ("we", "us", or "our"), the developer of MurmurAI.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for personal or commercial purposes
• Use the Free tier features without payment
• Use Pro tier features upon purchasing a valid license

3. Pro License Terms

• Device limits: Your license may be activated on a limited number of devices as specified at the time of purchase
• Non-transferable: Licenses are tied to your purchase and cannot be transferred to another person
• No resale: You may not resell, sublicense, or distribute your license
• Verification: The App may periodically verify your license status with our servers

4. Restrictions

You agree NOT to:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works of the App
• Circumvent or attempt to circumvent license verification
• Share, distribute, or make available your license key to others
• Use the App for any unlawful purpose
• Remove or alter any proprietary notices or labels on the App

5. Third-Party Services

The App may integrate with third-party services. Your use of these services is subject to their respective terms:

• OpenAI: If you use OpenAI for AI refinement, you must comply with OpenAI's terms of use and provide your own API key
• Ollama: If you use Ollama for local AI refinement, you must comply with Ollama's license terms
• Gumroad: Purchases are processed by Gumroad and subject to their terms
• Apple App Store: App Store purchases are subject to Apple's terms and conditions

We are not responsible for the availability, accuracy, or content of third-party services.

6. Intellectual Property

The App, including its design, code, features, and documentation, is protected by copyright and other intellectual property laws. We retain all rights, title, and interest in and to the App.

Your content: You retain all rights to your audio recordings and transcripts. We do not claim any ownership over content you create using the App.

7. Disclaimer of Warranties

We do not warrant that:

• The App will be error-free or uninterrupted
• Transcription results will be 100% accurate
• The App will meet all your requirements
• Any errors in the App will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or business opportunities
• Costs of procurement of substitute services
• Any damages arising from your use or inability to use the App

Our total liability shall not exceed the amount you paid for the App license.

9. Refunds

Direct purchases (Gumroad): We offer refunds within 30 days of purchase if you are not satisfied with the App. Contact us at the email below to request a refund.

App Store purchases: Refunds for App Store purchases are handled by Apple according to their refund policy.

10. Termination

We may terminate or suspend your license immediately, without prior notice, if you:

• Violate any provision of these Terms
• Engage in license abuse or piracy
• Use the App for illegal purposes

Upon termination, your right to use the App ceases immediately. Sections regarding intellectual property, disclaimers, and limitations of liability survive termination.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through good-faith negotiation.
